What is Professional Negligence?

Professional negligence occurs when a professional fails to fulfil his/her duties to the required standard.  For example a solicitor may miss the deadline for issuing Court proceedings meaning that your claim automatically fails.

For a professional negligence claim to succeed you must show that you were owed a duty of care by the professional in question, that they breached that duty and that you suffered a financial loss as a result of their negligence.

Who is classed a “professional” for the purposes of professional negligence?

The following professions are included:-

  • Barristers and other lawyers such as legal executives
  • Solicitors
  • Conveyancers
  • Estate agents
  • Surveyors
  • Architects
  • Accountants
  • Tax Advisors
  • Insurance companies/brokers
  • Claims companies

If you are unsure as to whether you can bring a professional negligence claim, you can call us on 01925 937070 or email and one of our expert solicitors will be able to advise you.

What about doctors or healthcare professionals?

You can bring a professional negligence claim against a doctor or a healthcare professional, but this is classed as medical negligence (also known as clinical negligence) and is a separate area of law.  We also deal with medical negligence claims.  Further details can be found here on our medical negligence page.

Time Limits in Professional Negligence Claims

There are strict time limits in bringing a professional negligence claim, usually it is six years from the date of the negligence.  However this may be extended where the negligence only becomes apparent at a later date known as “date of knowledge”.  It is always best to speak to a solicitor as soon as you become aware of the negligence to ensure that you do not miss the time limit and your claim becomes ‘statute barred’, meaning that your claim is likely to fail as the Defendant will argue your claim is out of time.  Call us today to speak to one our solicitors on 01925 937070 and find out whether you have a professional negligence claim.

What if the professional has gone out of business or has no assets?

Most professionals, particularly solicitors and barristers are required to have professional indemnity insurance in place to cover such claims.  We will investigate this at the outset of any claim.
