Examples of Professional Negligence

Examples of situations where your solicitor, legal adviser or licensed conveyancer may have been negligent are:-

  • Failure to act on client’s instructions;
  • Failure to investigate title or ownership of the property;
  • Failure to carry out relevant searches and enquiries;
  • Failure to advise about restrictive covenants, easements or rights of way;
  • Failure to advise that a survey should be obtained;
  • Failure to advise that a property is on a flood plain;
  • Failure to register (or seek removal of) charges at the Land Registry upon completion;
  • Failure to ensure that the plan shows the correct boundaries of the property;
  • Failure to address boundary or access issues;
  • Defects in the Contract of Sale/Transfer or incorrect advice given;
  • Failure to advise on absence of planning permission, building regulations, consent, listing buildings consent etc.

These are just some examples of mistakes made by solicitors, legal advisers or licensed conveyancers made during the conveyancing transaction.

Time Limits for Professional Negligence Claims

There are strict time limits in bringing a professional negligence claim, usually it is six years from the date of the negligence.  However this may be extended where the negligence only becomes apparent at a later date known as “date of knowledge”.  It is always best to speak to a solicitor as soon as you become aware of the negligence to ensure that you do not miss the time limit and your claim becomes ‘statute barred’, meaning that your claim is likely to fail as the Defendant will argue your claim is out of time.

These time limits are very strict and therefore if you think you have a claim, you should always act without delay.
