It is sometimes necessary to transfer and register those rights into another person’s name, for example if the last surviving parent who owned the grave rights dies, the next of kin may want to have the rights registered in their name as rightful owners. 

In this case the Burial Authority (usually the local authority) will ask the persons who are seeking to register the rights of burial in their name to swear a statutory declaration before a solicitor and/or commissioner of oaths.

Our Fees for Statutory Declarations – Rights of Burial

There is usually a fixed fee of £5.00 for the solicitor to administer the declaration.  If there are any exhibits or forms to be attached to the statutory declaration the solicitor may charge £2.00 for each exhibit (for example a form of renunciation if there is anybody who is giving up the right of ownership).
