How to Make an Employment Tribunal Claim

An Employment Tribunal can deal with the following claims:-

Time limits

You usually have to bring a claim within 3 months of the termination of your employment or of the problem occurring.


Although there are some exceptions to the rule, it is now mandatory in the vast majority of cases for you to notify the Advisory, Conciliation and Arbitration Service (Acas) of your intention to bring a claim in the Employment Tribunal.  If you do not obtain an early conciliation certificate from Acas your claim will be rejected by the Tribunal.

The Claim Form

If you prefer you can print off the claim form and post it to the employment tribunal and send it to the Employment Tribunal’s Central Office:-

Employment Tribunal Central Office (England and Wales), PO Box 10218, Leicester LE1 8EG 

You should ensure that you obtain proof of postage and keep a copy of the claim form for your records.   You should also telephone the tribunal office to check that they have received your claim, especially if you are close to the time limit.  It is only in exceptional circumstances that the Employment Tribunal will accept a claim out of time.

How much is the fee in Employment Tribunals?

Following the recent successful appeal by Unison, the Supreme Court ruled that the Government’s decision to charge fees was unlawful.  Therefore there are no longer any fees to pay to bring a claim in the Employment Tribunal.  Anybody who has paid a fee over the last four years is entitled to a refund.
