Case Study A

In one case the office premises at which the Claimant worked were devastated by fire. When the Claimant had finished helping his employer clear up he tried to go back to his telephone sales duties.  However, because there was no heating and all the windows were open to disperse the smoke and fumes.  He therefore asked to leave early because he was so cold and was given permission to do so by his manager.  However, he was later dismissed.   The tribunal found that he was dismissed for protesting about having to stay at work in conditions that posed a risk to health and safety.

Case Study B

Another case, the Claimant, a bus driver, refused to drive the bus when his indicators failed, after reporting the failure.  He was dismissed from his job and in his unfair dismissal claim the tribunal accepted that he reasonably believed he was in serious and imminent danger.

Circumstances where you can claim unfair dismissal for health and safety reasons

a)     Where (if designated by the employer to carry out activities in connection with preventing or reducing risks to health and safety at work) you carried out or intended to carry out activities to prevent or reduce risks to health and safety at work

b)     Where you performed or were proposing to perform functions as a safety representative

c)     Where you brought to your employer’s attention a concern about health and safety at work where there was no representative (or where it was not reasonably practicable to raise the matter by those means)

d)     Where you left or proposed to leave the workplace (or dangerous part of it) or refused to return in circumstances where you believe that there was a serious and imminent danger which you could not prevent

e)     In circumstances where you believed there was serious and imminent danger and took appropriate steps to protect yourself and others from the danger.

There are strict time limits for bringing a claim in the employment tribunal so you should not delay in seeking advice.
