What is unfair dismissal?

Unfair dismissal is a statutory right giving employees with one year's service the right to complain to a tribunal that they have not been treated fairly or reasonably by their employer.

If you have been made redundant and the redundancy process was not carried out correctly or have otherwise been unfairly dismissed, an employment tribunal may award compensation.

In some circumstances, an Employment Tribunal can find automatic unfair dismissal to which there is no defence and which prescribes an uplift of compensation by up to 50%.
