Unfair Dismissal - Time Limits

UNFAIR DISMISSAL TIME LIMITS

Time limits in the Employment Tribunals for unfair dismissal claims are:-

 i) Short

Unfair dismissal claims must normally be presented to the Employment Tribunal WITHIN THREE MONTHS beginning with the Effective Date of Termination, so that if the Effective Date of Termination was 8th July 2010 the last date for presentation of an unfair dismissal claim would be 7th October 2010.   

ii) Strict

The Employment Tribunal will not allow an extension of time to the time limits except in exceptional circumstances and in reality it is very difficult to bring unfair dismissal claims out of time.  

For the above reasons an unfair dismissal claim should be submitted to the relevant Employment Tribunal office in good time.
