The redundancy process should be carried out correctly by your employer. It will not be a redundancy situation if the employer cannot demonstrate one of the following:
- Closure of the entire business
- Closure of the place the employee works
- Requirement for reduction of the workforce
Redundancy Procedures
There must be a fair selection of employees for redundancy, usually by first selecting a pool of employees then applying a list of fair and objective criteria to narrow down the pool to those to potentially be dismissed.
Your employer must warn you of the risk of redundancy and must consult with you so that you can state your case. Your employer should also discuss and consider suitable alternative employment and ways to avoid dismissal. You should be permitted the opportunity to appeal the decision.
If you have been made redundant, you may be entitled to redundancy pay.You also need to be given the correct notice period, outstanding wages and holiday pay.
