Definition of Race in the eyes of the Law

Under the Race Relations Act of 1976, the definition of "racial discrimination” is when somebody is discriminated against on the grounds of their race, nationality, ethnic origin or colour.

Types of Race Discrimination in the Workplace

In the workplace there are four main types of discrimination that could lead to a claim for compensation being made:

Direct

This is when somebody is actively and purposefully discriminated against purely because of their race.

Indirect

When something within the company such as a rule, code or procedure is introduced that disadvantages or makes things difficult for somebody of a certain race.

Harrassment

When there is offensive behaviour towards the individual that can cause them offence or that creates an atmosphere in which they feel intimidated. This can take many forms, such as racist jokes or mocking of certain religious clothing for example.

Victimisation

In employment law this has a slightly different meaning to the dictionary definition. In this case it means that somebody is treated badly because they have made a complaint about racial discrimination within the workplace.

One exception to the above is when a job is advertised that specifically and genuinely requires a person of a certain ethnic origin to be able to fulfil the role.   This is called a "genuine occupational requirement."

Dealing with Discrimination

If you feel somebody is discriminating against you on the grounds of race then there are a number of avenues for dealing with it.

The first is to speak informally to your employer to try to resolve the situation, however if this fails you may then need to take legal advice.
