Legal Definition of Disability

In order to make a claim, there is a legal definition of disability that will be considered. We will be able to advise you on your situation specifically, but below is the definition in the eyes of the law:

A long term impairment of either the physical or mental kind that substantially prevents you from carrying out normal day to day activities

Forms of Disability Discrimination

There are a number of different ways in which somebody can be discriminated against in the workplace due to their disability. The main ones are listed below:

Direct

This is when an employer treats an employee less favourably on the grounds of their disability, in a similar situation. It must be proven that the discrimination was specifically due to the disability

Not Making "Reasonable Adjustments”

Employers are expected to make "reasonable adjustments”, i.e. ways they can help the employee to make life easier, and improve their working conditions in spite of their disability.

This could involve making changes within the building (ramps etc), providing tailored equipment, allowing reasonable time off to attend medical appointments etc. There are many others, and it all depends on your individual circumstances - we will be able to advise you on your individual situation.

Harassment

General harassment in the workplace can be traumatic enough and is not acceptable at any time, but for somebody to be harassed because of their disability, for example jokes being made at their expense, it is even worse.

Victimisation

In employment law, the definition of victimisation is actually somebody being treated unfairly because they have made a complaint of discrimination, in this case disability. 

Unfair Dismissal

If you have been dismissed and you feel it is directly because of your disability, then you may also be entitled to compensation for an unfair dismissal claim.
