The Disability Discrimination Act 1995 protects employees, ex-employees and job applicants and applies to companies or firms of any size.

A disability is defined as a physical or mental impairment, which has a substantial and long-term effect on the ability to carry out normal day-to-day activities.

"Long-term” means lasting or likely to last 12 months.

"Affecting normal day-to-day activities” means having an impact on mobility, manual dexterity, physical co-ordination, continence, ability to lift, carry or move objects, speech, hearing or sight, memory or ability to concentrate, perception of risk or physical danger.

An employer has a duty to make reasonable adjustments to prevent an employee being at a substantial disadvantage because of his disability.

Victimization of a person who brought or is considering bringing a claim under the Disability Discrimination Act is also unlawful and can give rise to a further claim.

Harassment is unwanted conduct on the grounds of a victim's disability with the effect of violating the victim's dignity or creating an intimidating, degrading, humiliating or hostile environment for the victim.

An employer can be liable for the discriminatory acts of its employees, done in the course of their employment, whether the employer was made aware of the discrimination or not.
