Some of the contractual disputes at work issues we deal with are:

Notice Periods except in limited circumstances your employer must provide you with the notice period prescribed in your employment contract or the statutory minimum notice period, whichever is higher. If your employer has dismissed you and not given you sufficient notice or pay in lieu of notice, you may be able to claim damages for breach of contract.

Unlawful Deductions from Wages, generally your employer may not make deductions from your wages. However, there are some circumstances in which your employer will be permitted to make deductions. Contact us for further advice.

Variation of Contract, if your employer has a contractual right to vary the terms of your contract you will be in breach of contract if you refuse to comply with the new terms.

Your employer may vary the terms if you agree to the amendments but if your employer attempts to vary your employment terms without your agreement, he may be in breach of contract. If the new terms are radically different from the original terms, you may be able to claim unfair dismissal from the first contract.

Other Breach of Contract, if your employer's breach of contract is fundamental, you may be able to claim constructive unfair dismissal if you have resigned as a result. This area of employment law is fraught with difficulties and you should speak to an employment law solicitor as soon as possible.

At DSM Legal in Warrington, Cheshire we offer an initial free consultation and in some cases a no win no fee if you decide to bring a claim. Contact us as soon as possible for further details.
